1.      NATURE OF THE COURSE & CERTIFICATION DISCLOSURES 

a.      The student acknowledges and explicitly agrees that the 6-Month Intensive Paralegal Studies Skills Training Short Course is a non-accredited certificate course conducted via distance e-learning. It is purposefully designed for practical skills and personal professional development.

b.     Four-Stage Certification Framework: To comprehensively recognize student progression, the qualification structure yields a total of four (4) distinct physical certificates, explicitly conditional upon meeting individual milestone academic criteria and full account settlement:

·         Three (3) Individual Module Certificates: Issued for each individual module (Module 1, Module 2, and Module 3) upon achieving the required pass mark on each module’s respective open-book evaluation.

·         Fourth (4th) Premium Certificate — Competency Certificate: The final premium qualification certificate issued strictly upon successful completion of all three (3) modular tests and full clearance of course fees.

 

2.      PAYMENT TERMS, MILESTONE LOGISTICS & TEST ACADEMIC STRUCTURE

a.      A non-refundable Upfront Deposit of R1,500 is required to secure enrollment and initiate initial material distribution.

b.     The student agrees to adhere to the integrated academic, testing, and pre-paid payment schedule below. Every scheduled evaluation is formally structured as an Open-Book Test to ensure practical application capability.

c.      Certificate Logistics Fee: The course fee is fully inclusive of a dedicated R500 allocation explicitly covering the secure production, printing, validation, and reliable door-to-door courier distribution of all four physical certificates upon final curriculum completion. This fee is fully integrated into Month 5 payment, to maintain an unambiguous total fee of R5,499.

3.      DEFAULT ON PAYMENTS & SUSPENSION OF SERVICES

a.      Should the Student or designated payer fail to pay any pre-paid installment or if a scheduled debit order bounces on the designated due date, Yolanda Gail & Associates (PTY) Ltd reserves the right to immediately suspend distance-learning support, assessment link access, grading, tutor communication, and withhold the courier dispatch of any subsequent physical modules.

b.     Exemption from the National Credit Act (NCA): This installment facility is offered purely as a strict operational convenience for self-study purposes and does not constitute a credit facility or formal credit agreement under the NCA. No interest, default interest, splitting fees, or deferral penalties are charged on outstanding balances.

c.      Consequently, learning support, test access, physical module logistics, evaluations, and certificate distribution will remain strictly frozen as a service suspension until account arrears are settled in full.

4.      EARLY CANCELLATION POLICY & REASONABLE PENALTY FEES 

a.      In terms of Section 14 of the Consumer Protection Act (CPA), the Student and Payer have the right to cancel this fixed-term distance-learning agreement prior to the 6-month completion date by giving Yolanda Gail & Associates (PTY) Ltd twenty (20) business days’ written notice.

b.     Pre-Existing Costs and Materials Retained: The Student explicitly acknowledges that any physical, custom-bound curriculum materials already couriered to them up to the point of cancellation remain permanently in the student’s possession and cannot be returned, credited, or refunded due to their custom nature and integrated intellectual property.

5.      Calculation of Reasonable Cancellation Penalty:

a.      Should the Student opt to cancel the agreement midway, the student and designated Payer remain jointly liable to pay:

                                                              i.      All monthly installments that became due and payable up to the effective date of the cancellation notice period.

                                                            ii.      A reasonable early cancellation penalty equal to 15% of the total remaining balance of the course fee, as permitted by Regulation 5 of the CPA, specifically calculated to recoup administrative processing losses, unamortized enrollment onboarding costs, and intellectual property deployment.

5.1 No student distance-learning academic records, subsequent study materials, individual module certificates, or final Competency Certificates will be issued or couriered if the student’s account holds any historical arrears or unpaid cancellation penalties.

5.2  Yolanda Gail & Associates (PTY) Ltd takes the privacy of your personal information seriously and is committed to processing data in full alignment with the Protection of Personal Information Act (POPIA).

5.3 By signing this form, the students and designated Payer explicitly consent to Yolanda Gail & Associates (PTY) Ltd processing their personal data (including Name, ID, Address, Banking Details, and Contact details) strictly for distance-learning administration, debit order installment processing, couriering study materials, and managing student communications. Your data will never be sold, leased, or shared with unauthorized third parties.

6.      LIMITATION OF LIABILITY 1

a.       Yolanda Gail & Associates (PTY) Ltd provides educational training and practical guidance but influences neither individual student employment outcomes nor the specific legal rulings of active legal cases. Results vary from case to case and student to student.
